I think that's a freaking amazing ruling. At the very least it pushes the regulation of electronic cigarettes back a little while. Now though we are going to have problems with candy type flavorings that traditional tobacco have been required to remove. Hopefully the removal of tobacco flavorings would not be required since they do not appeal to children. Oh and warning labels for products containing nicotine such "not a safe alternative to smoking" taking up at least 50% of the label. It will be very interesting to see how the FDA retaliates.

I think Judge Leon made a very fair and responsible decision. He focused on the law and the authority granted the FDA and rightfully decided that they don't have authority over e-cigarettes since they don't contain tobacco, which is what the FDA DOES have regulation over. I'm not against regulation, I just think any regulation should be fair and not abusive.
